Law to be passed: Gujarat Assembly to pass law on love jihad on Thursday, current law on conversion to be amended

Following Uttar Pradesh and Madhya Pradesh, the Gujarat government will also work hard on the issue of love jihad

To introduce Lovejehad law in the name of Gujarat Religion Freedom Reform Bill 2021 in the Legislative Assembly

The Gujarat government, like Uttar Pradesh and Madhya Pradesh, has completed preparations to bring a law on love jihad. On Thursday, the last day of the budget session of the Legislative Assembly, the law will be passed by amending the Freedom of Religion Act 2003 and banning proselytizing activities in the name of love jihad in Gujarat. The law of this love jihad will be introduced in the assembly in the name of Gujarat Religion Freedom Reform Bill 2021.

The provision of fines and punishments under this Act will be made more stringent

The Gujarat Legislative Assembly on Thursday amended the Freedom of Religion Act 2003 to provide for stricter fines and penalties in cases of conversion through seduction, coercion, misrepresentation or any other fraudulent means. Thus this whole reform is to stop the activity of Love Jihad. According to the Uttar Pradesh pattern, the law against love jihad is undergoing major amendments and under its provision, a person found guilty will be punished for a minimum of three years and a maximum of five years - not less than Rs 2 lakh. If such an offense has been committed in the case of a minor or a person belonging to a Scheduled Caste-Adi caste, the punishment will be from 4 years to 7 years and a fine not less than Rs 3 lakh.

The state government has decided to lure young women to marry

The bill to amend the Gujarat Freedom of Religion Act 2021 has been approved in the state cabinet meeting. Which will be introduced in the House on the last day of the Legislative Assembly. The Gujarat Freedom of Religion Act 2003 is supposed to prescribe conversion through seduction, coercion or non-representation or any other fraudulent means. Yet conversions are taking place by promising a good lifestyle and assuming the wrong name. The decision has been taken by the state government due to the increasing number of cases of women being lured into marriage for the purpose of conversion. Hence these provisions have been introduced by the State Government.

According to the new clause, anyone with blood relatives can file a complaint

In the case of such love jihad, a new section 3K will be introduced, in which the offended person is not married or adopted by his parents, siblings or blood relatives but any other person who has first reported the matter to the ruling police station. Provision has been made for admission.

Those who help will also be prosecuted according to law

In the case of Love Jihad, legal action will also be taken against those who helped some individuals to commit the crime and action will be taken. In some cases, it will also become a non-bailable offense. A special provision has also been made that an officer below the rank of Deputy Superintendent of Police cannot investigate this. The new section 4 provides for punishment in connection with the sole purpose of converting a person by getting him married or helping him to get married. Unlawful conversion would be a non-bailable offense if the offense proved to be an offense committed to the institution and organization of the marriage.

According to the Love Jihad Bill, the accused was sentenced to 5 years imprisonment and Rs. A fine of not less than Rs 2 lakh will be imposed. Juvenile - Scheduled Caste - 7 years imprisonment and Rs. A fine of not less than Rs 3 lakh will be levied. A bill in the name of Gujarat Freedom of Religion Amendment Bill 2021 will be introduced in the Assembly. Section 22 of the Gujarat Freedom of Religion Act 2003 has been amended. Forced conversion will be banned. Forced conversion with any woman will be considered a crime. Legal action will be taken against the person who arranged the marriage. Anyone with blood relation to the female party can file a complaint under the law. Action will also be taken against those who help in marriage. Action will also be taken against the organization that arranged the marriage. This type of crime is considered non-bailable. The crime will be investigated by the district police chief and the DYSP. Organization - Punishment of 3 to 10 years and Rs. There will be a fine of Rs 5 lakh.

At present, the cases of love jihad are increasing across the country. This law has been implemented in Uttar Pradesh and Madhya Pradesh. The government is moving ahead to implement this law in Gujarat as well. It remains to be seen when this law will be implemented in Gujarat
